Abstract

This study aims to analyse the marine area protection system in Sabang City in accordance with the principle of ḥifz al-bi’ah within the maqāṣid of Sharia. This study employs a qualitative approach using descriptive analysis, as well as an empirical legal methodology, to evaluate the implementation of positive law and Sharia norms in the context of marine area protection. The research findings indicate that the marine area protection system in the City of Sabang is consistent with the practical application of ḥifz al-bi’ah within the maqāṣid of Sharia, whereby the government implements restoration efforts through the zoning of Regional Marine Conservation Areas (KKPD), the integration of national and local regulations (Qanun Aceh), as well as collaboration between the government, the community and relevant institutions in monitoring and protecting marine areas from damage. The integration of the principle of ḥifz al-bi’ah within the maqāṣid of Sharia strengthens the marine area protection system in the City of Sabang, this is realised through the principle of respect for nature by restricting the utilisation of natural resources within the zones, the principle of compassion by restoring and preventing damage to degraded ecosystems, the principle of responsibility by conducting routine monitoring by relevant authorities and the principles of simplicity and justice by enforcing fair sanctions for any violations.
