Abstract

This article examines the phenomenon of abandoned and damaged aid houses provided to disaster victims from the perspective of the concept of maslahah in Islamic law. Maslahah, as an important principle in maqashid sharia, emphasizes the achievement of maslahah and prevention of damage (mafsadah) for the community. In this context, aid houses should be a means of restoring and protecting the basic rights of victims. However, the facts show that many aid houses are abandoned, unoccupied, or damaged due to various factors, such as planning errors, minimal supervision, and lack of community participation. In this study, the author formulated research objectives in a problem formulation focused on answering three important issues: what is the basic concept of maslahah in Islamic jurisprudence (fiqh muamalah), how is the concept of maslahah reviewed in the utilization of tsunami relief housing, and what are the factors that cause tsunami relief housing to be neglected. This type of research, conducted using qualitative research and normative analysis of Islamic law and social policy literature, found that practices that cause relief housing to be neglected contradict the principle of maslahah, because they do not realize the benefits they should and instead cause harm. From the results of the study, it can be concluded that most do not fully reflect the principle of maslahah in Islamic jurisprudence (fiqh muamalah). It was found that a number of relief housing were left abandoned, damaged, or converted without considering the long-term value of benefits for tsunami victims. This contradicts the main purpose of providing assistance, which is to create benefits in the aspects of shelter, security, and survival.
