ANALISIS KOMPARATIF AKAD IJARAH MULTIJASA DALAM KOMPILASI HUKUM EKONOMI SYARIAH (KHES) DAN FIQH MUAMALAH

Abstract

This study aims to analyze comparatively the concept and implementation of ijarah multijasa (multi-service leasing) contracts within the framework of the Compilation of Sharia Economic Law (KHES) and Fiqh Muamalah. Using a qualitative descriptive-analytical approach with a normative legal analysis, the research examines both the textual provisions of KHES and classical as well as contemporary fiqh literature related to ijarah transactions. Data were collected through document analysis of primary legal sources, including KHES, DSN-MUI Fatwas, and relevant Supreme Court decisions, along with secondary sources such as regulatory documents from the Financial Services Authority (OJK) and scholarly writings. The findings reveal that KHES and Fiqh Muamalah share the same foundational principles of justice, contractual clarity, and the avoidance of gharar (uncertainty), all of which align with the objectives of maqasid al-shariah. However, KHES adopts a more formal and codified approach, providing legal certainty within Indonesia’s judicial framework, whereas Fiqh Muamalah is normative and flexible, emphasizing ethical values and adaptability through ijtihad. The study concludes that both frameworks complement each other, KHES ensuring legal structure and enforceability, and Fiqh Muamalah maintaining moral integrity and contextual relevance. Strengthening the integration of these two systems is essential to develop a responsive, just, and maqasid-oriented Islamic economic law framework in Indonesia.
