PARTISIPASI MASYARAKAT DALAM LEGISLASI DI INDONESIA MENURUT KONSEP SYURA

Pelaksanaan legislasi Indonesia melibatkan partisipasi masyarakat. Posisi dan kedudukan partisipasi masyarakat tersebut diakui di dalam Undang-Undang No. 12 Tahun 2011 Tentang Pembentukan Peraturan Perundang-Undangan (UUP3). Dalam perspektif Islam, peran serta masyarakat juga diakui dalam konsep syūrā. Untuk itu permasalahan yang dikaji ialah apa bentuk partisipasi masyarakat di dalam proses legislasi, serta bagaimana pelaksanaan partisipasi masyarakat dalam UUP3 menurut konsep syūrā? dan bagaimana pandangan syura terhadap legislasi di Indonesia? Kajian penelitian ini menggunakan pendekatan yuridis normatif ataupun statute approach. Hasil penelitian ini bahwa bentuk-bentuk partisipasi masyarakat dalam legislasi di Indonesia ialah partisipasi melalui organisasi, lembaga, instansi terkait melalui Rapat Dengan Pendapat Umum (RDPU), masukan secara lisan/tertulis di tiap tahapan pembentukan peraturan perundang-undangan atas nama individu dan kelompok dilakukan secara daring dan luring, melalui kegiatan konsultasi publik, RDPU, kunjungan kerja, loka karya, seminar, diskusi, melalui kegiatan konsultasi publik yang lainnya. Ditinjau menurut konsep syūrā, partisipasi masyarakat di Indonesia yang diatur dalam UUP3 sesuai dengan konsep syūrā, karena dalam syūrā serta dalam partisipasi masyarakat di Indonesia, keterlibatan masyarakat telah diakui dalam pengambilan keputusan melalui jalan syūrā/musyawarah. Dengan demikian legislasi di Indonesia sangat relevan dan sesuai dengan pembentukan hukum dalam pandangan Islam.

Waqf has great potential to strengthen society through the distribution in an Islamic economy and the productive use of resources. Waqf is an instrument in the Islamic economy which has a significant role in the social and economic development of the people. Waqf is a gift of assets that cannot be sold, inherited or transferred ownership, which are used for the good and welfare of the community. Pierre Bourdieu is a French sociologist known for his contributions to social and cultural theory. His thinking has been very influential in various fields, including sociology, anthropology, and cultural studies. Several key concepts developed by Bourdieu include habitus, social, cultural and economic capital, and arena (field). This research analyzes the interaction between economic capital and social capital in waqf management. This research uses a qualitative methodology with a case study approach in several law enforcement agencies in Indonesia. Data collection used interviews conducted with great consideration, data analysis was carried out by applying Bourdieu's economic and social theory to identify individual behavior for each modality in Bourdieu's time management. The results of the analysis of Economic Capital and Social Capital in Waqf Management using Pierre Bourdieu's approach can include several important findings and contributions. This analysis provides a more comprehensive understanding of the complexity of waqf management, by considering the interaction between economic capital and social capital. This makes it possible to look beyond just economic or social aspects. Using Pierre Bourdieu's approach, these results illustrate the application of social theory in the context of waqf management. This shows that social theories can provide a deep understanding of the structural dynamics and interactions in Muslim societies. This conclusion has practical implications for waqf management, by providing insight into how economic and social capital influences waqf management practices. This can help waqf managers and policy makers to design more effective strategies. This analysis also contributes to the literature on waqf management, by providing a new and comprehensive perspective, these results can help in empowering communities to optimize the benefits of their waqf, as well as strengthening shared prosperity.

SUPERVISION OF HOTEL APPLICATIONS IN BANDA ACEH CITY

This study aims to determine the use of labeling for sharia hotels in Banda Aceh City, to
determine the halal guarantee for hotels that are not labeled as sharia in Banda Aceh City,
and to comply with supervision of sharia regulations in hotels in Banda Aceh City. In this
study the author uses a qualitative research method with a descriptive pattern. Data were
collected through interviews, documentation, and literature studies. Data analysis focuses
on the labeling of sharia hotels in Banda Aceh City ( study of Sharia Labeled And Non
Labeled Hotels). The results of the study indicate that to obtain labeling the hotel must obtain
a permit and maintain order, although not all hotels in Banda Aceh City have sharia
labeling, but they also comply with sharia rules and they also prohibit guests who are not
non-muhrim couples. The halal guarantee system for sharia hotels that refers to a series of
hotel rules or policies and procedures applied to hotel operations must be in accordance
with sharia principles. Supervision of hotels in the Banda Aceh city o focuses on sharia
regulations, namely to ensure comfort for visitors. and see the halalness of products and
provide services that support business actors in obtaining halal certification.

CHANGE OF THE FUNCTION OF GREEN OPEN SPACE (RTH) LAND INTO COMMERCIAL LAND IN GAMPONG TIBANG, SYIAH KUALA DISTRICT

This research aims to examine the change in the function of green open space (RTH) into commercial land in Gampong Tibang, Syiah Kuala District, Banda Aceh, based on the concept of maslahah. Changes in land function in Gampong Tibang include the conversion of RTH land into residential areas, businesses, and public facilities that conflict with the ecological function of the land. This phenomenon has a significant impact, such as decreasing environmental quality, decreasing water absorption capacity, and increasing the risk of flooding. This study uses an empirical legal approach with a descriptive qualitative analysis method. Data were obtained through interviews, observations, documentation, and literature studies. The results of the study show that there has been a change in the function of RTH in Gampong Tibang due to rapid urbanization which has encouraged the conversion of RTH in Gampong Tibang into residential and commercial areas. Although in accordance with Banda Aceh City Qanun Number 2 of 2018 and Perwal Number 13 of 2021 concerning RDTR, this change reduces water absorption capacity and increases the risk of tidal flooding. Land conversion is strictly regulated through the RTRW and RDTR, which allow changes according to their designation. However, ecological impacts and sustainability must be considered so that development continues to support environmental balance. From a maslahah perspective, this change fulfills the basic needs of society (maslahah dharuriyyah) such as housing, but still requires careful planning to ensure environmental sustainability and the long-term welfare of future generations

THE RESPONSIBILITY OF PT. PEGADAIAN SYARIAH BANDA ACEH FOR THE LOSS OF COLLATERAL OBJECT

PT. Pegadaian Syariah is an alternative financing institution that provides loans based on the law of pawn, which requires the submission of movable goods as collateral from customers to PT. Pegadaian Syariah. The focus of this study is on the form of responsibility and the explanation of how PT. Pegadaian Syariah Banda Aceh resolves compensation for the loss of the pawned objects. To answer this research question, the method used is a normative juridical approach. Normative juridical is a system for selecting legal regulations, doctrines applied to provide answers to legal cases, and using a statute-based approach. The findings of this study conclude that if a case of damage or loss of collateral occurs during the pawn process, PT. Pegadaian Syariah is responsible for the damaged or lost collateral. In providing compensation, PT. Pegadaian Syariah must adhere to the provisions set out in the Pawnshop Work Procedures Handbook, which governs how compensation should be provided if the collateral is lost
