BA’I IN THE COMPILATION OF SHARIA ECONOMIC LAW: ANALYSIS OF E-COMMERCE TRANSACTIONS FROM A CONTEMPORARY FIQH PERSPECTIVE

The development of digital technology has transformed the practice of buying and selling (ba'i) from a conventional model to an electronic system (e-commerce). This transformation poses complex challenges within the framework of Islamic law, particularly regarding the absence of a contract meeting (majlis al-'aqd), the intangibility of the object, and the high potential for gharar (uncertainty). This study aims to analyze the compatibility of e-commerce transactions with the principles of ba'i in Islamic law and its dispute resolution mechanisms based on the Compilation of Sharia Economic Law (KHES). Using a normative-doctrinal research method with a qualitative approach, this study concludes that e-commerce transactions can be considered sharia-compliant if they fulfill the principles of mutual consent (taradhin), clarity (bayyanah), and the avoidance of usury (riba) and gharar. KHES serves as a solution framework by accommodating analogy (qiyas) with the salam contract, establishing information obligations, and providing dispute resolution mechanisms through sharia mediation, arbitration by BASYARNAS, and litigation in the Religious Courts. Synergy between regulators, e-commerce platforms, and public education is needed to strengthen a just and sharia-compliant digital economic ecosystem.References
